a. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:

Unusual and compelling urgency Exclusive licensing agreements Industrial mobilization

FAR 13.501(2)

Other:

b. Reason for Authority Cited:

This requirement is a direct replacement upgrade of the current Mercury Marine outboard engines used on all 13 Harbor Security boats. Changing of motor brand/type would result in the requirement for 24 mechanics to attend a $5,000 three week course to qualify on another engine brand for the estimated total of $120,000. Motor/brand change would also require the update of existing rigging parts, such as but not limited to, steering cable, throttle and shift cables, hydraulic lines and electrical wiring at an estimated cost of $20,000, plus approximately $10,000 for labor per security boat, totaling an estimated $390,000. The efforts to change and adapt other brands would cost the government an estimated total of $510,000 and would create extensive down time of craft and an inability to support around the clock harbor security missions at Naval Base installations. The engines must fit exactly in all aspects on existing Harbor Security boats that currently have Mercury Marine engines to ensure system operation and integrity.

5. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by

FAR 5.201.

6. Actions to Increase Competition:

The proposed solicitation will be synopsized on the SAM.GOV website. Brand Name only Mercury Marine engines are required for compatibility with current Port Ops boat operations and requirements.

7. Market Research:

The required supplies are available commercially. Market research indicates there are three small businesses that have the ability to meet the needs of this requirement. These sources were found through google searches, sba.gov search, and manufacturer’s website.

8. Actions to Remove Barriers to Future Competition For the reasons set forth in Paragraph 4, NAVSUP FLCPS has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NAVSUP FLCPS will assess whether competition for future requirements is feasible.

9. Any Other facts supporting the use of other than full and open competition.

Not applicable.
