JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
(>$3,500 but not exceeding the SAT)
1. Identification of Requiring Activity and Contracting Activity.
Requiring Activity – Contracting Activity – Requisition Number –
2. Nature and description of contract action.
The acquisition of the supplies or services described below is an exception to the fair opportunity process to be awarded as a new contract award. The placement of a Fixed-Firm Price contract is anticipated.
This request for contractual procurement is a new request to replace the aging steering system for the Training Squadron Vessel (TSV) 1 – Prevail. During the annual vessel survey for TSV-1 Prevail, the navigation system was identified as needing to be replaced. Replacement of the current steering system is required for the annual certification process for the Training Squadron Vessels.
3. Limited to the following source(s).
This proposed acquisition is to acquire several items as part of the NAVIPILOT system. These items are required in order to integrate the new navigation system. The NAVIPILOT/4KP/BASICNAVIPILOT 4000+ consists of the following:
074927-0000-000 – CDU
022922-0000-000 – Dongle for NAVIPILOT4000+ 074851-0000-000 – Steering Control Unit 074851-0000-000 – Steering Control Unit 020041-0000-000 – 115V AC Bang Bang Solenoid 074780-0000-000 – NP4000 CAN Bus Connection Board 060290-0000-000 – Power Connection Unit 074835-0000-000 – Steering Mode Selector Switch 074835-0000-000 – System Switch 074836-0000-000 – NFU Controller 820-1005 – Hehn Adapter Plate 820-1004 – Top Adapter Plate 074477-0000-000 – Control Lamp Module with 4 Ind. 4. Identification of the justification rationale. The statutory authority that permits not providing each awardee a fair opportunity to be considered for each order exceeding $3,500 issued under a multiple award contract is 10 U.S.C. 2304c, as implemented by FAR 16.505(b)(2)(i). The applicable exception to the fair opportunity process for this justification for the award of an order exceeding $3,500, but not exceeding the simplified acquisition threshold, is:
This is a justification for the use of items particular to one manufacturer, under the authority of 10 U.S.C.
2304c, as implemented by FAR 16.505(a). Identify the particular brand name, product, or feature of a product that is particular to one manufacturer. Address why the particular brand name, product, or feature is essential to the Government’s requirements. Discuss market researching indicating that other companies’ similar products do not meet or cannot be modified to meet the agency’s needs. (See FAR 16.505(a)(4)(i))
An older version of this NAVIPILOT system is currently installed on and is in need of an upgraded replacement of the system by the same manufacturer. Due to the age of the currently installed NAVIPILOT system, it is past the ten year support timeline offered by the OEM Sperry Marine. There are no new or refurbished parts available to fix the steering system.
Other brands were researched; however, none of them would be able to be seamlessly integrated into the current steering and navigation systems currently installed on the TSV-1 Prevail. If the NAVIPILOT 4000+ is not purchased, the TSV-1 Prevail will continue to be inoperable or in a “Fail to Sail” status. This would deprive USFFC/CSG-4 of a vital training component. To change the navigation system to another brand would require significant rework of the current system to accommodate a different brand. Several subsystems that tie into the steering/navigation system would need to either be fully replaced, or otherwise modified to work with another brand of steering/navigation systems. The NAVIPILOT system ties into ship’s existing operating systems. To replace all these components to accommodate a new navigation system would not be in the best interest of the Government.
In addition to requiring a significant rework of existing systems, the ship’s crew would need to be trained in the new system. This training would take additional time away from their normal duties in support of CSG-
4. The lost time, additional funds required to rework the current system, and retraining of ship’s crew would prevent the requesting agency from fulfilling its’ obligations to the ongoing mission for the Department of Defense, Navy, and the Government in general. Purchase of the NAVIPILOT 4000+ is in the Government’s best interests.
5. Specific characteristics of the supplies or services support an exception to the fair opportunity process (i.e., unique features, function of the item, etc.). Describe in detail why only this/these supplies/services and/or awardee(s) can furnish the requirements to the exclusion of other supplies/services and/or awardees.
The NAVIPILOT system is already in use by TSV-1 Prevail. NAVIPILOT is the OEM for TSV-1 Prevail.
The subsystems that connect to the NAVIPILOT system will not work with any other brand of navigation/steering systems. To change brands would require a significant overhaul of the navigation system and subsystems. It is estimated that this would result in an additional cost of $150,000.00, at minimum, just to convert to a different system. This does not include an estimate of the additional down time that would coincide with this overhaul or the retraining of the ship’s crew to familiarize with the new system.
TSV-1 Prevail is currently in a “Fail To Sail” status, which is considered a work stoppage. Purchase of the NAVIPILOT 4000+ system presents the lowest cost in terms of not only price but in terms of lost time from being in a “Fail To Sail” status.
6. Market Research. Provide a description of the market research conducted among awardees and the results thereof OR a statement of the reason market research was not conducted.
Market research was conducted by the requiring activity, TSV-1, USFFC, CSG-4 and NAVSUP FLC Norfolk Contracting Department. A web search was performed, as well as a search through GSA Advantage, FPDS Reporting, SAM.GOV to see if there were any Government Wide Acquisition Contracts (GWAC), Infinite Delivery Infinite Quantity (IDIQ) or Blanket Purchase Agreements (BPAs) that could provide the NAVIPILOT 4000+ system. There are no alternate methods to procuring this system outside of purchasing directly through the OEM (Sperry Marine) or one of their networked dealers.
