PERFORMANCE WORK STATEMENT

FINGERPRINT SERVICES

NAVAL SERVICE TRAINING COMMAND ENTERPRISE

1.0 - BACKGROUND

The NSTC Enterprise consists of NSTC, NROTC and subordinate commands with locations nationwide. NSTC is requiring a digital fingerprinting service solution capable of providing services to all midshipmen, active duty personnel and government employees located within the continental United States including Hawaii and have those fingerprints submitted to the DCSA (or their successors) via SWFT (or their successors). NSTC has an estimated requirement of approximately 1,250 fingerprints required per year and an additional not to exceed 250 fingerprints per year that will be supported under this contract.

2.0 - PURPOSE

The Naval Service Training Command Enterprise has a requirement to collect and submit electronic fingerprints via

Secure Web Fingerprint Transmission and the Secure Web Fingerprint Transmission Plus applications (or their successors), as part of the Department of Defense security clearance investigation process, to the Defense

Counterintelligence and Security Agency (or their successors).

3.0 - SCOPE

The scope of this Performance Work Statement (PWS) shall be limited to the actions performed under Section 7.0.

4.0 - PERIOD OF PERFORMANCE

See the line item details for the Period of Performance (POP).

5.0 - PLACE OF PERFORMANCE

Fingerprinting services shall be performed on the Contractor’s premises. Please see 7.6 for requirements on fingerprint location requirements.

6.0 – TECHNICAL POINT OF CONTACTS

All references and responsibilities to the Technical Point of Contact (TPOC) may be delegated to a designated

Government authority, but only at the TPOC’s request.

7.0 – TASKS

7.1 The Contractor shall submit electronic fingerprints to the Defense Counterintelligence and Security Agency website or its successors by collecting fingerprints in the required format to meet SWFT and DCSA standards, found on https://www.dcsa.mil/is/swft/ and https://psa.dmdc.osd.mil/psawebdocs/docPage.jsp?p=SWFT.

7.2

The Contractor shall digitize and submit hard-card fingerprints into the SWFT system if a digital capability does not exist in an area specified by the applicant during the scheduled appointment.

7.3

The TPOC shall provide a list of SONs as well as the SOI and Intra-Government Payment and Collection codes that shall be used during SWFT fingerprint submissions. The Contractor shall ensure that any changes to the SON, SOI, or IPAC codes submitted by the TPOC shall be updated within three business days.

7.4

During performance of this contract, the Contractor shall have access to Privacy Act Information and PII. The

Contractor shall safeguard all PII, and ensure this data is accessed and maintained in accordance with applicable laws and regulations.

7.5

The Contractor shall provide a point of contact and alternate(s) that shall be responsible for performance of this contract. These POC’s shall be fully qualified in the relevant profession, trade, or field, and shall hold any licenses required by law. The names of these POC’s shall be designated in writing and provided to the TPOC and

Government.

7.6

All fingerprinting services shall be performed on the Contractor’s premises. Contractor locations shall be located per

9.3.

7.7

Appointments shall be utilized to the maximum extent practicable through the Contractor’s web-based appointment system as required under 9.2.

7.8

Monthly billing reports shall be submitted per Section 11.0.

8.0 – CONSTRAINTS

8.1

In the case where the Contractor identifies extra work outside of the tasks listed in section 7.0, the TPOC shall be consulted first prior to commencement of work. Only the TPOC can approve of additional items to be installed, which shall require a formal contract modification prior to commencement of work.

8.2

The Government shall not furnish any equipment for the performance of this contract. The Contractor shall provide all equipment required for the performance of this contract. The Contractor shall ensure that all equipment used to capture fingerprints is compatible with SWFT and shall be operational 90% of the time.

8.3

The fingerprint submission quality and acceptance rate by DCSA shall be, at a minimum, 95% acceptance.

Fingerprints that are returned unacceptable shall be recaptured and resubmitted to DCSA by the Contractor at no cost to the Government.

The TPOC shall be the only person authorized to place fingerprint orders.

9.0 – CONTRACTOR REQUIREMENTS

9.1

The Contractor shall be approved to enroll and submit online submissions of electronic fingerprints to SWFT prior to award, and shall maintain this enrollment for the life of the contract. If the Contractor at any time loses this approval, the Contractor shall notify the TPOC within two business days.

9.2

The Contractor shall have a web-based appointment system which shows a list of available sites based on address/zip code. This web-based system shall be capable of associating a registration code (or similar) with each individual Submitting Office Numbers for billing and tracking purposes. Appointments shall allow maximum flexibility for users.

9.3

The Contractor’s locations shall all be located within:

- 15 miles of 25% of the serviced NROTC units

- 10 miles of 50% of the serviced NROTC units

- 5 miles of 75% of the serviced NROTC units

- No facility greater than 100 miles from the serviced NROTC units

11.0 – DELIVERABLES

Monthly billing reports, with a breakdown by SON, shall be submitted by the TPOC showing the number of fingerprint submissions for the month, and total to date. Billing invoices are to be submitted per Section 10.0.

12.0 – INVOICING

The Contractor shall be responsible for submitting invoices and initiating receiving reports electronically through

Wide Area Work Flow – Receipt and Acceptance (WAWF) for goods and services rendered under this Contract.

Invoices shall be submitted monthly.

If not already registered, Contractor personnel shall self-register as a “Vendor” under “User Roles for WAWF” at the web site: https://wawf.eb.mil/, and be activated by the Contractor’s designated Electronic Business Point of

Contact (EBPOC). Please note that WAWF will not be able to allow any invoicing until there is an EBPOC established – the WAWF help-desk should be called (866-618-5988) and consulted further in cases when EBPOC has not been established. Lastly, for the “Location Code”, use your company’s CAGE code. WAWF training is available on the internet at http://wawftraining.com.

The Contractor shall submit invoices for payment and initiate receiving reports relative to the units of measure established in the contract. For example, if the unit of measure is 1 then invoicing can only commence once the

Period of Performance has expired; multiple units of measure allow multiple invoicing, most commonly in the form of multiple months. The Government shall process invoices for payment and associated receiving reports when in receipt in the WAWF system.

When initiating documents within WAWF, Contractors shall use the appropriate Department of Defense Activity

Address Code (DoDAAC) codes established in the included DFARS clause 252.232-7006 located in the clauses section in this contract.

13.0 – PRIVACY ACT STATEMENT

Pursuant to Title 5 United States Code 552a(m)(l), the contractor and all employees of the contractor working under https://wawf.eb.mil/ http://wawftraining.com/ this contract are required to comply with the requirements of 5 U.S.C. 552a (“The Privacy Act of 1974”).

14.0 – IDENTIFICATION OF CONTRACTOR EMPLOYEES

In accordance with DFAR 211.106, there shall be a clear distinction between Government employees and service contractor employees. Service contractor employees shall identify themselves as contractor personnel by introducing themselves or being introduced as contractor personnel. Contractor personnel will be required to obtain and wear badges or other visible identification for meetings with Government personnel to provide a clear distinction between service contractor employees and Government personnel. In addition, contractor personnel shall appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

15.0 – NON-PERSONAL SERVICES STATEMENT

Contractor employees performing services under this order will be controlled, directed, and supervised at all times by management personnel of the contractor. Contractor management will insure that employees properly comply with the performance work standards outlined in the SOW. Contractor employees will perform their duties independent of, and without the supervision of, any Government official or other Defense Contractor. The tasks, duties, and responsibilities set forth in the task order may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the

United States Government, overseeing the work of Federal employees, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.

16.0 – NMCARS 5237.102-90 ENTERPRISE-WIDE CONTRACTOR MANPOWER REPORTING

APPLICATION (ECMRA).

The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the fingerprint services via a secure data collection site. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:

1) W, Lease/Rental of Equipment;

2) X, Lease/Rental of Facilities;

3) Y, Construction of Structures and Facilities;

4) D, Automatic Data Processing and Telecommunications, IT and Telecom- Telecommunications Transmission

(D304) and Internet (D322) ONLY;

5) S, Utilities ONLY;

6) V, Freight and Shipping ONLY.

The contractor is required to completely fill in all required data fields using the following web address: sam.gov.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year

(FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at sam.gov.

17.0 – NAVY USE OF ABILITYONE SUPPORT CONTRACTOR - RELEASE OF OFFEROR

INFORMATION (MARCH 2018)

NAVSUP FLC NORFOLK may utilize contractor support through the AbilityOne Program, as needed, to perform contract closeout functions for this acquisition. Information, including business sensitive/confidential or proprietary data, that the offeror provides to the Government or information already in the possession of the Government may be viewed and utilized by the AbilityOne Program support contractor personnel during the course of its contract performance. The information that may be made available to the support contractor may include, for example, pricing and technical proposals, historical contract, pricing and performance information, Commercial Asset

Visibility (CAV) reporting information and similar data/information.

By submission of a proposal in response to this solicitation, the offeror and its subcontractors consent to a release of their business sensitive/confidential or proprietary data to the Government's AbilityOne Program support contractor personnel in order to perform close out services. Prior to the release of any such information to the support contractor, the support contractor will have in place with the Government a Non-Disclosure/Non-Use Agreement in accordance with the terms of the AbilityOne Program support contract.

Offerors may execute their own Non-Disclosure Agreement with the AbilityOne Program (AbilityOne contact information available from the contracting point of contact). The support contractor must provide copies of the executed agreements to the Contracting Officer and the Contracting Officer's Representative (COR) for the support contract; and the offeror/contractor for this acquisition must provide copies of the executed Agreement to the

Contracting Officer for this acquisition. If the offeror/contractor seeks such a Non-Disclosure Agreement with the

AbilityOne Program support contractor, the Agreement must be executed no later than the date of final delivery under the resulting NAVSUP FLC NORFOLK contract.
