About this file

This document is a justification and approval for using other than full and open competition to procure ABAQUS Finite Element Analysis software and maintenance from Dassault Systemes. The Naval Sea Systems Command, Naval Surface Warfare Center, Carderock Division requires the ABAQUS software to predict vibration and pressure responses of complex, submerged structures with frequency dependent material properties and predict signatures using government-developed software. The software is necessary as ABAQUS is the only package able to solve fluid loaded structural acoustic problems containing materials with complex frequency dependent properties, and has been used for the majority of signature prediction models supporting vessel programs. Alternatives would require significant time and estimated costs of over $2 million to evaluate, verify, and transition to. Therefore, this non-competitive procurement of ABAQUS software and maintenance totaling approximately $300,000 from Dassault Systemes, the original equipment manufacturer, is justified.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Carderock Division (NSWCCD), Contracting & Acquisitions Department (Code 02).

2. Description of the Action Being Approved

NSWCCD intends to purchase ABAQUS Finite Element Analysis software and maintenance. ABAQUS is used to predict vibration and pressure responses of complex, submerged structures with frequency dependent material properties and predict signature using in government developed software. NSWCCD intends to award a firm-fixed price contract to DS Government Solutions Incorporated, a subsidiary of Dassault Systemes, the manufacturer of ABAQUS.

This justification document is in accordance with FAR 13.501(a).

The total estimated value of the acquisition is approximately

Service Cost Center funds will be used for this purchase. The SCC will be reimbursed by FY 2023 RDT&E funds, primarily form

PMS450X.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. §2304(c)( 1).

The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency. (FAR 13.106-1(b)(2))

5. Rationale Justifying Use of Cited Statutory Authority

The supplies and services contemplated with this procurement consists of software, software maintenance of ABAQUS Finite Element Analysis software. Though there are resellers, only the manufacturer and Immix Technology Group are authorized to sell to the government.

Division 7200 has purchased permanent licenses on numerous occasions worth in today’s dollars.

There is currently a 90 day backlog of jobs to be run on the Division’s cluster. This purchase is to add enough licenses to fully utilize the cluster and provide maintenance for the software. This amounts to an investment of in new permanent licenses as well as maintenance on the total portfolio.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Division 7200 has used other finite element analysis software packages in the past including NASTRAN, Virtual Lab (no longer available), NE NASTRAN, ANSYS and Optistruct. ABAQUS was the only package found that could solve fluid loaded structural acoustic problems containing materials with complex frequency dependent material properties.

The majority of the models for signature predictions supporting VIRGINIA and COLUMBIA classes used ABAQUS for the structural acoustics portion of signature predictions. The models not using ABAQUS were early models that are no longer of interest to the programs.

Using a different software package will induce uncertainty when comparing predictions.

For NSWC to replace ABAQUS, a suitable analysis package would have to be evaluated and the results of a previous ABAQUS solved propulsor and full ship model verified. Any such finite element package would be more expensive since Division 7200 does not have substantial investment in any of these packages. The cost associated with changing software is estimated to be $2M. Additionally, the engineers would be in a stop work condition after 15 July without access to the current modeling tools including ABAQUS and the programs they support will be unable to complete their milestones.

Pursuant to FAR 13.501(a)(1)(iii), the Government will make this justification available on the Government point of entry (SAM.gov). The Government will ensure that the contract file will be documented as to any responses received from making the justification available.

7. Determination of Fair and Reasonable Costs

In accordance with FAR 13.106-3(a), the Procuring Contracting Officer (PCO) shall ensure that all services provided under the anticipated purchase order are procured at a fair and reasonable price. The Government will require the contractor to submit a formal quote and sufficient information to support the accuracy and reliability of the estimate. The PCO shall determine that the proposed order represents the best value (as defined in FAR 2.101) to meet the Government’s needs.

A financial estimate was made using MSC NASTRAN as a potential package using the GSA schedule contract GS- 35F-0265X_139.

It is estimated that verifying the alternative software package would require significant investment of man hours. The following table quantifies the estimate.

Task Man Year Cost Quantity Cost Full Propulsor Model (4 man months) $220,602.00 0.3 $66,180.60 Full Ship Model (2 man years) $220,602.00 2 $441,204.00 Retooling of Predicition Codes and utilities $220,602.00 0.5 $110,301.00

Total $700,185.60

Additionally, 15 engineers would require training on the alternative package. Is estimated to cost $160K for the course and 2 man weeks per engineer.

The total cost of an alternative package is hence estimated to be $2M. The engineers would be less productive for a period of at least 4 months as they adjust to the alternative package.

Additionally, the engineers would be in a stop work condition after 15 July without access to the current modeling tools including ABAQUS.

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

NSWCCD will assess whether competition for future requirements associated with the FEA supporting the Integrated Acoustic Model. However, NSWCCD’s requirement is a unique case, because ABAQUS is proprietary to Dassault Systemes Inc, the historical database of models solved in ABAQUS and the significant investments in translators and utilities to create ABAQUS models and translate ABAQUS results for the Integrated Acoustic Model. Although market research does suggest that other vendors offer some capability of providing finite element models, the costs and installation of these software are both costly and time consuming to meet the mission requirements for Division 72.

More so, previous work with these other software packages have demonstrated that they do not possess the unique capabilities of solving fluid loaded models containing complex frequency dependent material properties nor the utilities required to use the results in the Integrated Acoustic Model. If future requirements involving the Integrated Acoustic Model develop, the PCO will assess whether the circumstances surrounding the need to obtain the required supplies/services without full and open competition have changed in a manner to allow for competition in meeting those future requirements.
