JUSTIFICATION AND APPROVAL

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical software support to be used by the in support of the manufactured by Data Physics.

3. Description of Supplies/Services

The NSWSCDD currently has a requirement to procure one (1) base year plus two (2) option years of software support for Data

Physics software. The following is specifically required:

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is $417,400.00 for the base year and option years. Navy Working Capital Funds

(NWCF) will be utilized for this procurement.

4. Statutory Authority Permitting Other Than Full and Open

Competition

41 U.S.C. 1901 as implemented in FAR Subpart 13.5.

5. Rationale Justifying Use of Cited Statutory Authority

Currently, the and various

NSWCDD and Naval Surface Warfare Center Indian Head utilize Data Physics hardware supported by Data Physics

SignalStar Matrix, Mobilyzer,and SignalCalc software. This hardware and software is used to in support of qualification and development programs for the Navy. The current inventory of Data Physics hardware and software is proprietary to Data Physics Corporation. This procurement will allow for software updates/maintenance to the existing software. If this software support is not obtained for the current Data Physics software, it would be necessary to replace all existing test software and hardware for our resulting in a duplication of costs in excess of

$1,000,000.00, a cost not likely to be recovered through full and open competition. Additionally, data that has already been collected with existing hardware and software may require re-testing and validation resulting in additional costs.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Market research was conducted via internet search and discussion with industry to see if any alternate vendor could provide control system software compatible with the existing Data Physics hardware. This research met with negative results. Due to the proprietary nature of this requirement, no additional market research was conducted. Data Physics Corporation does not have authorized distributors for the required support.

The proposed contract was synopsized on the Federal Business

Opportunities (FEDBIZOPPS) website on 27 July 2020 and only Data

Physics expressed interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Data Physics to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the software support covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract

Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
