Rationale:
This equipment is an essential tool to provide HSI the ability to communicate over long distances during emergencies when normal means of communications are disrupted or are unavailable. Currently HSI is provided with this service for 5 MCCs and 1 TICS by Incident Communication Solutions, LLC DBA PEAKE under contract 70CMSD18P00000116 which will expire on 26 September 21. This service for our MCC vehicles will include VSAT service and maintenance provided by Peake and all 5 VSATs will need to be identical in service and compatible with each other in order to communicate.
This service will also allow HSI the ability to communicate between offices and/or remote locations without needing any infrastructure (i.e., cell phone towers, landline phones, or commercial power). The MCC is utilized during ESF-13 deployments and in support of investigations and operations throughout the United States.
The VSAT system, with 1.2M antenna dish, provides connectivity for reach-back into the ICE network. The VSAT system supports Internet, data, and 6 Voice over Internet Protocol (VoIP) telephone traffic for each MCC. The VSAT system shall enable users to connect to the ICE network with DHS/ICE approved security (e.g., Virtual Private Network [VPN] concentrator and DHS/ICE image).
The hardware and firmware for each of the 5 Mobile Command Centers and TICS that are all pre-positioned across the United States holds proprietary software, firmware, licenses and passwords owned by the current vendor. In order to obtain service from another vendor the modems, switches, routers and VoIP phones on each of these vehicles would need to be replaced and subsequently reprogrammed, licensed and updated by the new vendor requiring them to visit each of the locations independently incurring travel and labor costs which in total are estimated to be in excess of $100,000.
PEAKE is also the only vendor that offers and currently provides a 10-day period of UNLIMITED MGB upload and download service and will then subsequently charge $40.00 a day for UNLIMITED MGB upload and download service for the remainder of the required service days of any operating month.
4. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106- 3(a)(2). (Check one and provide short description of action taken.)
☐ Market Research.
☐ Comparison of the proposed price with prices found reasonable on previous purchases.
☐ Current price List.
☐ Comparison with similar items in a related industry.

Short description of how price was determined fair and reasonable:
ICE/OAQ has previously purchased this VSAT service from Incident Communication Solutions, LLC DBA PEAKE on contract # 70CMSD18P00000116, which covers our current period of performance under this order. Per unit price, cost on 70CMSD18P00000116 was determined fair and reasonable and the unit price cost for the new contract is anticipated to be at a lower cost, prior service was used to estimate the cost of this service at about $ 5,154.00 per month for the base year and is estimated increase to be $10,608 once the additional 6 platforms are placed into service and their service costs begin during option year 1. HSI TACCOM unit requires the purchase of monthly access/service for eleven (11) Very Small Aperture Satellite Terminal (VSAT) systems for the MCC vehicles and one (1) TICS to be used for emergency communications during deployments for emergency situations and investigations and operations as dictated by HSI HQ.
Currently, Peake is the only vendor able to provide this service in that Peake is the only source viable to avoid communication disruption and to fill the capability gap.
The VSAT service provided currently by Incident Communication Solutions, LLC DBA PEAKE is required to ensure consistency and compatibility for interoperable communications for all of 5 MCC Vehicles and the 1 TICS. There are 6 more Mobile Command Centers that are being purchased under contract# 70CMSD20FR0000123 that will each have one-year subscriptions of service provided by PEAKE and our current MCC’s and TICS service must remain consistent with the new systems to ensure interoperability and compatibility as they enter the fleet of MCC’s over the next year. Any change in service provider could result in loss of service and be of serious detriment and potentially catastrophic to the overall success of the ICE mission.
