U.S. NUCLEAR REGULATORY COMMISSION
JUSTIFICAT~ONFOR OTHER THAN FULL AND OPEN COMPETITION
Statutory Authority:
The authority permitting a noncompetitive procurement is FAR Subpart 13.106-1 (b) and FAR Subpart 13.5, which provides for limiting competition in situations not exceeding $24,000, where the Contracting Officer determines that only one source is reasonably available.
Description of the Action Being Approved:
The U.S. Nuclear Regulatory Commission (NRC) proposes to enter into a sole source contract with Operation Technology, Inc to conduct the Electrical Transient Analysis Program (ETAP) training course. The period of performance will be three months from the award date at an estimated cost of $24,000.
Description of Services Required:
The purpose of this contract is to provide a five day Electrical Transient Analysis Program training course for 15 NRC participants.
Demonstration that the Proposed Contractor's Unique Capabilities - Qualifications requires the use of this Authority:
NRC has a need to procure a training course on the independent analysis and review of the electrical analysis performed by most licensees who utilize ETAP, the NRC staff must be properly trained to fully utilize ETAP's various intricate software features. The ETAP training provided by OTI covers in depth training of ETAP's fully integrated software solutions including arc flash, load flow, short circuit, relay coordination, cable ampacity , transient stability and optimal power flow. OTI is sole provider and developer of ETAP training.
Description of Efforts to Contact as Many Sources as Practicable:
No other U.S. source is known to have the capability of being able to provide this training. OTI is sole provider and developer of ETAP training. A notice of intent was posted on the NRC website in accordance with FAR
5.101 (a) (2). No responses were received.
Determination that Costs Are Fair and reasonable:
Prior to contract award, the Contracting Officer will make a determination that the cost to the Government is fair and reasonable.
Market Research Conducted:
The NRC continues to peruse the market for viable alternative sources. In addition, a notice was posted on the NRC website; no responses were received.
Other Facts supporting the Use of Other Than Full and Open Competition:
None
List of Sources that expressed An Interest:
No sources, either before or after the NRC website posting expressed an interest, in writing, in the acquisition.
Statement of Actions NRC May Take to Remove Barriers to Competition:
The NRC looks to the private industry to invest and further develop leading edge electrical transient analysis programs and training. As this investment unfolds, it is anticipated that this area will open-up thus allowing for the removal of competition barriers.
