JUSTIFICATION AND APPROVAL
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a sole source basis for critical equipment to be used by the NSWCDD Dam Neck Activity manufactured by
Microwave Photonic Systems, Inc.
3. Description of Supplies/Services requires six(6) each, Fiber Transmitter, part number MP-8001-40-UTX-00-10-01-2-3;
twelve (12) Fiber Receiver, part number MP-8000-RX-00-15-02-00-0- 2-3; four (4) Fiber Optic Interface Cable, part number 1600-36.6- 2-4-SH-2-1-K-2-1-K; three (3) Integrated Rack Chassis, part number 2050701 ; manufactured by Microwave Photonic Systems, Inc.
The requested materials represents the minimum requirements of the government. Delivery is required by 1 April 2021 to avoid a delay in facilitating customer requirements in support of the project.
The Government's minimum needs have been verified by the certifying technical and requirements personnel.
The estimated cost of the proposed contract action is
Fiscal year 2020 Research Development Test & Evaluation (RDT&E) funds will be utilized for this procurement.

4. Statutory Authority Permitting Other Than Full and Open Competition
41 U.S.C. 1901 as implemented in FAR Subpart 13.5.
5. Rationale Justifying Use of Cited Statutory Authority
The Fiber Optic Components for , are required for an above project. These specific components have been identified as the sole pieces of hardware for form, fit, and function to match joint capabilities, therefore, proprietary data limits competition. Utilizing another brand of hardware will add an additiona1 12 months and in excess of $600,000.00 to the program in testing, evaluation and fielding that will not likely be recovered through full and open competition. If these items were not procured, the cost to the government to develop and produce hardware with matching form/fit/function could exceed $1,000,000.00 dollars. This would also be an unacceptable delay to schedule resulting in mission failure. Use of another vendor's product would cause risk with the project. The manufacturer of these products updates periodically to stay up to date with the latest drawings and schematics. To meet or exceed functionality inherent with these Microwave Photonic Systems Inc. would be cost prohibitive.
, would need to establish an organic tool development capability, requiring an estimated 6240 direct productive person hours of development at a cost of $600,000.00 resulting in extensive scheduling delays for integration, with no guarantee the developed products would meet current and future team requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research shows these products are manufactured by the Microwave Photonic Systems Inc. and are proprietary. Market research through vendor research and email contact has verified that this company does not have any authorized resellers for any of the products in this procurement and that all sales must be conducted directly with the manufacturer.

The proposed contract was synopsized on the Beta.Sam.Gov website on 1 February 2021 and only Microwave Photonic Systems Inc. & one from NEW TECH SOLUTIONS, INC. whom are not authorized reseller.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Microwave Photonic Systems Inc. to provide the required equipment.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of materials and licensing covered by this document.
If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
