Justification and Approval (J&A) for Other than Full and Open Competition
1. Defense Logistics Agency (DLA) Troop Support, Industrial Hardware Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements on an other than full and open competition basis.
3. Following is a description of the supplies required to meet DLA’s needs:

Woodward HRT (CAGE Codes 81873 and 60028) and Thomas Instrument (CAGE Code 5H860) Part Number (P/N) 3219-114

4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR Part 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. The use of this authority is necessary because Woodward HRT and Thomas Instrument are the only known approved sources for the required mounting bracket, which is a repair part designed and used exclusively .
Woodward is the Original Equipment Manufacturer (OEM) for the mounting bracket.
They have licensed the manufacture of this item to Thomas Instrument.
This bracket has been made in accordance with Woodward HRT’s proprietary drawings and specifications. There are no other known mounting brackets that are designed to fit the Growler F-18 aircraft. Failure of this part during flight would cause the pilot to immediately lose control of the aircraft due to loss of rudder control surface. If the part has a non-conformance that causes a failure or malfunction it could result in death or permanent total or partial disability. Its failure in flight would have major catastrophic consequences; hence the Navy’s Engineering Support Activity (ESA) has determined that this part is a Critical Safety Item (CSI). In accordance with DLA’s Performance Based Agreement (PBA) with the military services, the services are the approving authority for sources on DLA managed Critical Safety Item. The military service over-seeing this item is the Navy. Alternate items must qualify in accordance with Design Control Authority (DCA) procedures, as approved by the Navy’s ESA.
6. This requirement will be synopsized in Contract Opportunities as required by FAR 5.2. In addition, this justification will be published with the solicitation, redacted as necessary, in accordance with FAR 6.305(c).
7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be determined fair and reasonable based on price analysis and contractor submission of other than cost or pricing data, if necessary.

This item is proprietary to the Original
Equipment Manufacturer (OEM), Woodward. The Government does not possess the technical data to develop an item description or specifications for purposes of full and open competition. . In addition, a Sources Sought Notice (SSN) was published in Contract Opportunities (Beta.SAM.GOV) on October 10, 2019 to ensure that offers are solicited from as many potential sources as is practicable. The SSN closed on November 9, 2019
9. There are no additional facts supporting the use of other than full and open competition.

. If/when the license agreement with Thomas Instrument ends, Woodward may again quote on this item, given it continues to have the propriety right to manufacture this item.
11. The following actions will be taken to remove or overcome any barriers to competition and encourage the submission of offers for alternate products: (1) periodic screening of the assigned AMC/AMSC codes by a Product Specialist and (2) inclusion of Defense Logistics Agency Directive (DLAD) Procurement Note L04 “Offers for Part Numbered Items (SEP 2016)” in the solicitation encouraging the submission of offers for alternative products.
