4. Authority Cited:
Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:
Brand Name Justification
Program/Equipment: Agilent Q-TOF LC/MS
5. Reason for Authority Cited:
a. This instrument is needed for lifecycle replacement, to support an expanded laboratory mission, and ensure continuity of operations. Internal validation of the Agilent LC/MS for forensic casework applications was completed by USACIL Drug Chemistry Section. Validation is the process in which a procedure and associated instrumentation is evaluated to determine efficacy and reliability for forensic casework analysis. Internal validation is the accumulation of analytical test data within a laboratory to demonstrate that the procedure is performing as expected. The use of the Agilent LC/MS for examination procedures is documented in the forensic procedures (ISO 17025 ANSI ASQ National Accreditation Board).
b. Existing LC/MS instrumentation within the USACIL CFA Branch utilize the Agilent name brand of equipment. Purchasing this brand will greatly reduce any training required on software or hardware as all users are familiar with the existing interfaces used on Agilent systems. Additionally, this brand will fall under the umbrella of the already existing service contract set up with Agilent for preventative maintenance and service. The Agilent brand has demonstrated reliability and consistency for the types of analyses performed in this center. Data sharing between instrument computers will remain consistent which is important as data needs to be moved and shared regularly.
c. USACIL presently employs LC/MS instrumentation that is being lifecycle phased out.
LC and MS technologies have advanced beyond the present capabilities of the instrumentation currently being utilized. Additional growth in CONUS and OCONUS mission support areas, number of personnel, and number of trainees requires a greater quantity of instruments for use by personnel. Without this instrument, the mission could be halted as these systems are required to complete many of the high throughput cases within the drug chemistry section.
d. Impact.
1) The purchase of a different brand LC/MS system would result in the government incurring additional instrumentation equipment costs and long support time, (some parts are shared between systems).
2) Incurring delays in time sensitive mission support due to processes that would require re-training, re-validation and re-certification of laboratory processes. (ISO 17025 ANSI ASQ National Accreditation Board).
3) Minimal or no training would be require if procured from the identified brand name manufacturer, resulting in in no loss in casework production.
Program/Equipment: Agilent Q-TOF LC/MS
6. Efforts to Increase Competition: The Contracting Officer shall publish the notices required by FAR 5.201.
7. Actions to Increase Competition: DFSC research scientists are continually researching sources of information and services to enable forensic examiners to conduct effective and reliable examinations. Market research consists of internet research, literature reviews, discussions with vendors, and other professional resources attending forensic science and technical conferences and industry events. If DFSC identifies a similar requirement, every effort will be made to compete it to the maximum extent possible.
8. Market Research: Research was conducted on the internet and General Services Administration (GSA) GSA Advantage website by DFSC staff between October 2018 and June 2019 for this requirement. Continual review of new products and technologies is conducted by examiners within the Chemistry and Firearms Branch in order to determine the best commercially available product reliable for the task. In addition to the manufacturer Agilent, two small businesses were identified by the manufacturer that are also distributors of new Agilent LC/MS systems.
10: Other Facts: Procurement History: This is an instrument lifecycle replacement of an existing Agilent LC/MS instrument purchased over 7 years ago. A record of that purchase is not available for citation.
11. Technical and Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my k · · ··
.. air and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable.
This determination will be made using the following: □ cost analysis □ price analysis
□ should cost IGCE audit: identify the audit type
Other: identify the methodology or combination of methodologies that will be used
As a part of this basis, certified cost or pricing data:
□ will be required.
