4. Authority:

☒ FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited: The requirement is to deliver cadavers to Fort Hood, leave them for no less than four (4) days and pick up the cadavers at the end of training. The training is once per quarter with one additional training session to be determined. Finding a company to deliver cadavers has proven to be difficult. The training will be performed in a field environment. As indicated in the market research, no other business has been found to fill the requirement. The authority used, FAR 13.106-1(b)(1)(i), only one source reasonably available is the only authority applicable for these circumstances.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 apply and will be followed. On future requirements the Government will try to procure these items through full and open competition on the Government Point of Entry should the services be offered by new and emerging businesses.

Right now, this is not the case. CRDAMC will continue to evaluate the capabilities of other vendor's products and re-procure the products that provide the best value to the Government.

The Government will continue to seek new resources that will satisfy these requirements through continued market research, requests for Statements of Capability, and telephonic inquiries. Telephonic and world-wide-web inquiries resulted in no other vendors that could provide the maintenance and services for the will call system. A sources sought was posted from 8 August 2019 until 15 August 2019. A notice of intent to award sole source will be posted upon approval of this J&A.

7. Market Research: A sources sought was posted to FedBizOps from 8 to 15 August 2019 with no responses to the notice and no interested vendors. The previous contract was competed with a company from Arizona which was technically acceptable but cost much more than University of Texas Southwestern Medical Center. This company did not respond to the sources sought on this occasion. A notice of intent to award sole source will be posted upon approval of this J&A.

Conducting a small business search using the key word “Cadaver” resulted in eleven (11) small businesses. Five (5) of these companies provides for cadaver dogs and K-9 training, four (4) provides for mortuary and cadaver transportation services and supplies and one (1) provides for virtual reality anatomy training, (digital training). The final company is a viable small business that can fill the requirement and was part of a competition three years ago of which their pricing was determined not fair and reasonable. Of all eleven companies found, this final one is the only small business that could fill the requirement, however, as stated, this company did not respond to the sources sought. The customer provided recommended source is a large business. Based on the market research, the Contracting Officer has determined there are not two (2) or more small businesses that would be able to provide the cadavers in a field environment. The recommended procurement will be other than full and open to the recommended source who has said they can fill the requirement.

8. Other Facts: The previous contract is W81K00-18-P-0513 for a three month base and one twelve (12) month option, ending 30 September 2019. It was competed.
