FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole Source Justification and Approval

1. Contracting Activity: Mission and Installation Contracting Command – Fort Lee

2. Description of Action: The U.S. Army Logistics University, Technical Logistics College requests a firm-fixed-price contract with Caterpillar Inc. 14009 Old Galena Rd.

Mossville, IL 61552. The Government projects award for August 2016 and fiscal year 2016, Operations and Maintenance, Army funds will be used.

x An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

This action is a follow-on to contract W91QF5-15-P-0082. That contract was not competed under authority FAR Subpart 13.5.

3. Description of Supplies/Services: As part of the Automotive Maintenance Warrant Officer Basic Course 915A, students are required to complete a module on “Administer Engine Maintenance”. The Government requires that the contractor provide training for Caterpillar engine models C7, C9, C12, C13, Cl5, ACERT which are utilized in military tactical vehicles. Advanced Engine Troubleshooting Diagnostics, Maintenance, Use of Schematics and Wiring Diagrams, including emissions and electronic technician training is required. The contractor will be required to provide training at the contractor facility by incorporating classroom and hands on practical exercises for up to 12 students per instructor due to the required training, equipment and available space needed. Eight iterations of this class will be conducted in calendar years 2016/2017. 80 hours of classroom presentations and hands-on lab exercises will be provided on the following:

4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5:

Unusual and compelling urgency Exclusive licensing agreements Industrial mobilization x Other: Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: The required training is conducted by the original equipment manufacturer utilizing the technical expertise and experience of Caterpillar certified instructors. Caterpillar, Inc. is the only source able to provide this training and certification, thus allowing Warrant Officers for Tactical Vehicles to be trained on engines currently in use within the field. This training also allows for access to proprietary technical data and training materials that are not available to the Government. Training is required as part of the Program of Instruction (POI) Module Q within the 915A Warrant Officer Basic Course.

It is vital that students receive this training as it is used in the field to provide the Army with troubleshooting and repair. Passing this training is required for students to complete the 915A Warrant Officer Basic Course as well as requirements within the POI. If this J&A is not approved, the Technical Logistics College will not be able to provide students with the training and certification necessary to perform the required skillsets needed to complete the 915A Warrant Officer Basic Course and perform the duties as required of a Tactical Vehicle Warrant Officer. Not having Warrant Officers who have the necessary skills to troubleshoot and repair engines leaves soldiers vulnerable while in the field. The previous contract has expired leaving the Government vulnerable to not getting students the required training and certification needed.

6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201.

7. Actions to Increase Competition: The Government will continue to perform Market Research and issue Sources Sought Notices in order to identify any possible sources that can fulfill the required services as stated in the Performance Work Statement

(PWS).

8. Market Research: Market research was conducted between April-August 2016 to identify all qualified sources. The research was conducted via Internet by accessing various websites and gathering information relating to engine training. The research conducted did not result in any other possible sources besides Caterpillar, Inc. that can offer the required training and certification. The engines within the Tactical Vehicles of the U.S. Army are Caterpillar engines. Training and certification is required in order for the Government to steer away from reliance on solely Contractor Logistical Support.

Caterpillar’s engine training specific information is proprietary, thus only a Caterpillar certified instructor can provide the needed training.
